2. Binding

By registering with, accessing, purchasing from, or otherwise using this website, you agree to be bound by these Terms and Conditions.

The use of this website implies knowledge and acceptance of these Terms and Conditions. In some cases, including course registration, online purchase, event booking or submission of participant details, we may ask you to explicitly accept these Terms and Conditions.

If you do not agree with these Terms and Conditions, you must not use this website, purchase services through it, register for courses or events, or submit participant information.

3. Electronic communication

By using this website, purchasing services, submitting forms, registering for courses or communicating with us by electronic means, you agree and acknowledge that we may communicate with you electronically on our website, through online forms, by email or through other digital communication channels.

You agree that all agreements, notices, disclosures, confirmations, course instructions, joining links, payment information and other communications that we provide electronically satisfy any legal requirement that such communications should be in writing, unless mandatory law requires otherwise.

For courses, events and live online activities, electronic communication may include, but is not limited to:

  • registration confirmations;
  • payment instructions;
  • payment confirmations;
  • joining links;
  • online meeting instructions;
  • learning materials;
  • course updates;
  • timetable changes;
  • attendance-related communications;
  • certificate-related communications.

You are responsible for providing accurate and up-to-date contact details and for checking your email, including spam or junk folders, before and during the relevant course or event.

4. Training courses, CPD activities, workshops and events

Malta Quality Education may offer training courses, CPD activities, webinars, workshops, live online sessions, educational events and other professional development services through this website or through other official communication channels.

Unless expressly stated otherwise in writing, such courses and activities are provided as professional training or CPD initiatives and do not lead to an MQF/EQF qualification, accredited award, licence, professional certification or formal academic credential.

Course descriptions, dates, duration, delivery mode, fees, faculty, learning objectives, learning outcomes, participation conditions and certificates are published on the relevant course or event page or communicated through official Malta Quality Education channels.

Malta Quality Education reserves the right to make reasonable changes to non-essential course or event information where necessary for academic, organisational, technical or operational reasons, provided that the overall nature and purpose of the course or event are not substantially altered.

5. Course and event registration

Registration for a course, CPD activity, workshop or event may require:

  • submission of participant details;
  • submission of payer or billing details;
  • acceptance of these Terms and Conditions;
  • acceptance of the Privacy Policy;
  • completion of the applicable payment process.

Submitting participant details, completing an online form, placing an order or requesting information does not automatically confirm participation unless the applicable fee has been paid, where payment is required, and the registration has been accepted by Malta Quality Education.

A participant’s place is confirmed only after Malta Quality Education has received the applicable payment and matched it with the relevant registration or order details.

Where the person or institution completing the payment is different from the participant attending the course or event, the payer is responsible for providing accurate participant details and ensuring that the participant is informed of the registration and relevant data processing arrangements.

Malta Quality Education may refuse, suspend or cancel a registration where information provided is incomplete, inaccurate, misleading, unlawful or inconsistent with the purpose of the course or event.

6. Course fees and payment methods

Course and event fees are indicated on the relevant course or event page, registration page, checkout page or official communication issued by Malta Quality Education. Unless otherwise stated, fees are expressed in euro.

Payment may be made through the online payment methods available on the website, including payment gateways integrated with website, or by bank transfer where this option is made available by Malta Quality Education.

For bank transfers, the participant or payer must use the payment reference indicated by Malta Quality Education, where applicable, in order to allow the payment to be matched with the relevant registration or order.

Malta Quality Education shall not be responsible for delays in confirming registration where incorrect or incomplete payment references are used.

Any bank charges, currency conversion costs, intermediary bank fees or third-party payment fees applied by the payer’s bank or payment provider shall be borne by the payer, unless otherwise agreed in writing.

Participation is confirmed only after the payment has been successfully received and matched with the relevant registration details.

7. Course postponement, cancellation and minimum number of participants

Malta Quality Education reserves the right to postpone, reschedule or cancel a course, CPD activity, workshop or event where academic, organisational, commercial, technical or operational conditions prevent its proper delivery.

This may include, without limitation:

  • failure to reach the minimum number of paying participants;
  • unavailability of key faculty;
  • technical or platform issues;
  • force majeure events;
  • regulatory or operational constraints;
  • circumstances affecting the quality or feasibility of delivery.

Where a course or event is postponed or rescheduled, Malta Quality Education will inform registered participants using the contact details provided during registration.

Where a paid course or event is cancelled by Malta Quality Education before delivery, participants who have already paid the applicable fee may be offered either:

  • a new course or event date; or
  • a refund of the fee paid.

Malta Quality Education shall not be liable for any indirect costs, travel costs, accommodation costs, loss of opportunity, business interruption, loss of income or other consequential losses incurred by participants or institutions in connection with a course postponement, rescheduling or cancellation, to the maximum extent permitted by applicable law.

8. Participant cancellation and refunds

Unless specific refund conditions are stated on the relevant course or event page, cancellations by participants must be communicated in writing to Malta Quality Education.

The following general refund conditions apply to paid courses, CPD activities, workshops and events:

  • cancellation received at least 14 calendar days before the course or event start date: refund of the fee paid, less any payment processing or administrative costs already incurred;
  • cancellation received between 13 and 7 calendar days before the course or event start date: 50% refund of the fee paid;
  • cancellation received less than 7 calendar days before the course or event start date: no refund shall be due.

No refund shall be due for non-attendance, partial attendance, late arrival, early departure or failure to participate in one or more sessions, unless otherwise agreed in writing by Malta Quality Education.

Where permitted by Malta Quality Education, a registered participant may be replaced by another participant from the same institution before the course or event start date, subject to prior written communication and submission of the new participant’s details.

Refunds, where due, will normally be made using the same payment method used for the original transaction, unless otherwise agreed or technically required.

9. Consumer rights

Nothing in these Terms and Conditions is intended to limit any mandatory consumer rights that may apply under Maltese or EU law.

Where a participant acts as a consumer and mandatory cancellation or withdrawal rights apply, such rights shall be respected in accordance with applicable law.

Where a course, event, digital service or live online activity begins before the expiry of any applicable withdrawal period with the participant’s express request or consent, the participant may lose or limit the right of withdrawal in accordance with applicable law.

Where the purchaser is a business, institution, company, organisation or professional acting for purposes related to their trade, business or profession, consumer withdrawal rules may not apply.

10. Access to live online sessions

For live online courses, workshops, webinars or events, Malta Quality Education will provide access instructions, links and relevant joining information before the start of the activity or relevant session.

Participants are responsible for ensuring that they have a suitable internet connection, device, audio/video equipment and any software required to access the live online sessions.

Access links are personal to the registered participant and may not be shared with third parties without the prior written consent of Malta Quality Education.

Malta Quality Education shall not be responsible for a participant’s inability to access a session due to technical issues relating to the participant’s own device, connection, software, firewall, email settings, institutional IT restrictions or other circumstances outside Malta Quality Education’s reasonable control.

Participants must not record, download, reproduce, share or distribute live online sessions unless expressly authorised in writing by Malta Quality Education.

11. Attendance and certificates

Where a course, CPD activity, workshop or event includes a certificate, the certificate shall be issued on the basis of the participant details provided during registration and the attendance or participation records maintained by Malta Quality Education.

Malta Quality Education may require a minimum level of attendance or participation in order to issue a Certificate of Attendance or any similar document. Any such requirement will be communicated on the relevant course or event page or through official course communications.

Certificates of Attendance confirm participation in the relevant course or activity. Unless expressly stated otherwise, they do not constitute an MQF/EQF qualification, accredited award, licence, professional certification or formal academic credential.

Certificates may include:

  • participant name and surname;
  • course or event title;
  • course or event dates;
  • delivery mode;
  • total duration;
  • issuing organisation.

Participants are responsible for ensuring that their personal details are correctly submitted before the certificate is issued.

12. Course and event materials

Course and event materials, including slides, templates, handouts, recordings, documents, checklists, examples, videos and any other learning resources provided to participants, are made available for personal learning and internal professional use only.

Participants may not copy, reproduce, distribute, publish, sell, resell, upload, share publicly, modify or commercially exploit course or event materials without the prior written consent of Malta Quality Education or the relevant rights holder.

Course and event materials may include content created by Malta Quality Education, external trainers, speakers or third-party sources. All intellectual property rights remain with their respective owners.

Access to materials may be limited to a specific course edition, event, period or participant group.

13. Recording of live online sessions

Malta Quality Education may record live online sessions where this is necessary or useful for course delivery, participant access, internal quality assurance, documentation, evidence of delivery or improvement purposes.

Where a session is recorded, participants will be informed in advance.

Participants are responsible for managing their own camera, microphone, display name and chat participation during the session.

Recordings, where made available, are intended only for registered participants of the relevant course or event edition and may not be copied, downloaded, shared, published or distributed without prior written authorisation.

Recordings shall not be used for unrelated promotional or commercial purposes without appropriate consent.

14. Participant conduct

Participants are expected to behave professionally and respectfully during courses, workshops, events, live online sessions, discussions, chats and any related learning activities.

Participants must not:

  • disrupt sessions;
  • use abusive, discriminatory, offensive or unlawful language;
  • share access links with unauthorised persons;
  • record or distribute sessions without permission;
  • misuse course materials;
  • infringe intellectual property rights;
  • harass trainers, staff or other participants;
  • interfere with the proper delivery of the activity.

Malta Quality Education reserves the right to remove or restrict access to any participant who behaves in a disruptive, abusive, discriminatory, unlawful or otherwise inappropriate manner, or who breaches these Terms and Conditions or any course-specific instructions.

No refund shall be due where a participant is removed from a course or event due to serious misconduct or breach of these Terms and Conditions.

15. Changes to course programme, faculty or schedule

Malta Quality Education will make reasonable efforts to deliver courses and events in accordance with the published programme, faculty and schedule.

However, Malta Quality Education reserves the right to make reasonable changes to the course timetable, session order, faculty, speakers, platform, materials or delivery arrangements where necessary for academic, organisational, technical or operational reasons, provided that the overall nature and learning purpose of the course or event are not substantially altered.

Such changes shall not automatically entitle participants to a refund, unless the change substantially affects the core nature of the service purchased.

16. Intellectual property

We or our licensors own and control all of the copyright and other intellectual property rights in the website and in the data, information, materials and other resources displayed by or accessible within the website.

Course and event content may also include materials, know-how, presentations, documents, examples or recordings created by external trainers, speakers or contributors. Such materials remain protected by intellectual property rights and may be subject to additional restrictions communicated during the relevant course or event.

For course or event registrations, substitution of a participant may be allowed only with our prior written approval and subject to submission of the replacement participant’s details.

27. Breaches of these Terms and Conditions

Without prejudice to our other rights under these Terms and Conditions, if you breach these Terms and Conditions in any way, we may take such action as we deem appropriate to deal with the breach.

Such action may include, without limitation:

  • temporarily or permanently suspending your access to the website;
  • suspending access to course or event materials;
  • removing you from a live online session;
  • refusing to issue a certificate;
  • cancelling your registration;
  • contacting your internet service provider to request that they block your access to the website;
  • commencing legal action against you.

No refund shall be due where access is suspended or participation is terminated due to serious misconduct, unlawful conduct or material breach of these Terms and Conditions.

28. Force majeure

Except for obligations to pay money, no delay, failure or omission by either party to carry out or observe any of its obligations under these Terms and Conditions will be deemed to be a breach if and for as long as such delay, failure or omission arises from any cause beyond the reasonable control of that party.

Force majeure events may include, without limitation, natural disasters, war, civil unrest, epidemics, pandemics, governmental restrictions, internet outages, platform failures, power failures, serious illness or unavailability of key personnel, or other events beyond reasonable control.

Where a course or event is affected by force majeure, Malta Quality Education may postpone, reschedule, adapt or cancel the activity in accordance with these Terms and Conditions.

29. Indemnification

You agree to indemnify, defend and hold us harmless from and against any and all claims, liabilities, damages, losses and expenses relating to your violation of these Terms and Conditions and applicable laws, including intellectual property rights and privacy rights.

This includes, without limitation, claims arising from:

  • unauthorised sharing of course materials or recordings;
  • unauthorised sharing of access links;
  • misuse of third-party platforms;
  • provision of inaccurate participant or payer information;
  • breach of participant conduct obligations;
  • infringement of intellectual property rights.

You will promptly reimburse us for our damages, losses, costs and expenses relating to or arising out of such claims.

30. Waiver

Failure to enforce any of the provisions set out in these Terms and Conditions and any agreement, or failure to exercise any option to terminate, shall not be construed as a waiver of such provisions.

Such failure shall not affect the validity of these Terms and Conditions or of any agreement or any part thereof, or the right thereafter to enforce each and every provision.

These Terms and Conditions will be interpreted and construed exclusively in English.

All notices and correspondence relating to these Terms and Conditions will be written in English, unless otherwise agreed in writing.

These Terms and Conditions, together with our Privacy Policy, Cookie Policy and any additional contract, registration condition, course-specific condition or written agreement applicable to a particular service, course, CPD activity, workshop or event, constitute the entire agreement between you and ARP Group Ltd in relation to your use of this website and the relevant services purchased or accessed through it.

Where course-specific conditions are published on a course page or communicated in writing, they shall apply together with these Terms and Conditions.

In case of conflict between these Terms and Conditions and a specific written agreement or course-specific condition expressly accepted by the parties, the specific written agreement or course-specific condition shall prevail for that specific matter.

We may update these Terms and Conditions from time to time.

It is your obligation to periodically check these Terms and Conditions for changes or updates.

These Terms and Conditions shall be governed by the laws of Malta.

Any disputes relating to these Terms and Conditions shall be subject to the jurisdiction of the courts of Malta.

If any part or provision of these Terms and Conditions is found by a court or other competent authority to be invalid and/or unenforceable under applicable law, such part or provision will be modified, deleted and/or enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions.

The other provisions will not be affected.

This fee includes the full costs for a one-day accreditation visit and the review process until completion. This fee also covers the cost of a three-member peer review panel. In the case of online/blended provision, a fourth panel member will be appointed. This fee is calculated on a one-day accreditation visit. If, during the process, it is determined that additional days are required, the applicant will be informed accordingly, and an additional fee will apply.
